1. Introduction
Welcome to Witnessor. These Terms of Service (“Terms“) are a legal agreement between you and Holiness Witnessor Ministries, a Texas domestic nonprofit corporation with 501(c)(3) status (“Witnessor,” “we,” “us,” or “our“), governing your use of the Witnessor mobile application and any related services (together, the “Service“).
Please read these Terms carefully. By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

3. Eligibility
You may use the Service only if you meet all of the following:
- You are at least 13 years of age.
- If you are between 13 and the age of majority in your jurisdiction (typically 18 in Texas), you have the consent of a parent or legal guardian who has reviewed and agreed to these Terms on your behalf.
- You are not barred from using the Service under the laws of your jurisdiction.
- You agree to provide truthful and accurate registration information.
We reserve the right to refuse service, terminate accounts, or cancel access at any time at our discretion, consistent with applicable law.
4. The Service
The Service provides access to devotional and scriptural content, including but not limited to Bibles (with audio), reading plans, devotionals, ebooks, audiobooks, a Q&A section, and related features. Content is provided for personal, non-commercial spiritual study and edification.
Because we are a religious nonprofit ministry, all content on the Service is currently provided free of charge and no payment or credit card is required to access the Service.
5. Your Account
5.1 Authentication
We authenticate users by phone number and a one-time SMS passcode (OTP). You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.
5.2 Accurate Information
You agree to provide accurate, current, and complete information during sign-up and to keep that information up to date. You may update or delete your profile information at any time from the Settings screen within the App, or by contacting us.
5.3 Unauthorized Use
Notify us immediately at [email protected] if you believe your phone number, account, or device has been used without your authorization.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Copy, reproduce, distribute, publicly display, or create derivative works from any content in the Service except as expressly permitted.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service, except to the extent this restriction is prohibited by applicable law.
- Circumvent, disable, or otherwise interfere with security, authentication, or rate-limiting features.
- Use automated means (bots, scrapers, crawlers) to access the Service, except for public search engine indexing of material we have published publicly.
- Upload or transmit any material that contains viruses, malware, or other harmful code.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Harass, abuse, threaten, or harm other users, staff, or third parties through the Service.
- Resell, sublicense, or commercially exploit the Service or its content.
7. Intellectual Property
7.1 Our Content
The Service, including its software, design, trademarks, logos, audio, and curated content, is owned by or licensed to Witnessor and is protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for personal spiritual study and edification.
7.2 Scripture and Third-Party Content
Certain Bible translations, devotional works, ebooks, and audiobooks made available through the Service are the property of, or used under license from, their respective publishers, authors, or rights holders. All such content remains the property of its respective owner and is subject to its own copyright notices and permissions. You agree to respect all such notices and restrictions.
7.3 Your Feedback
If you send us feedback, suggestions, or ideas about the Service, you grant Witnessor a non-exclusive, worldwide, perpetual, royalty-free license to use that feedback for any purpose without compensation to you.
8. Donations
The Service may, in the future, provide information about supporting Witnessor through voluntary donations. Donations to Holiness Witnessor Ministries are made to a 501(c)(3) nonprofit and may be tax-deductible in the United States to the extent allowed by law. Consult your tax advisor. We do not currently collect payments through the App.
9. Privacy
Our collection and use of your personal information are described in the Privacy Policy, which is incorporated into these Terms by reference.
10. Messaging and Notifications
Phone numbers collected during sign-in are used to send one-time sign-in verification codes (transactional SMS). We do not send marketing SMS, push notifications, or email unless and until you expressly opt in. Standard message and data rates from your carrier may apply to verification codes.
11. Modifications to the Service
We may add, remove, or change features of the Service at any time without prior notice. We are not liable to you or any third party for any such change, suspension, or discontinuation.
12. Termination
12.1 By You
You may stop using the Service at any time. You may request account deletion by emailing [email protected] or through the in-app settings where available.
12.2 By Us
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if continued access could harm Witnessor, other users, or third parties.
12.3 Effect of Termination
Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution) will survive.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITNESSOR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE ACCURATE, COMPLETE, OR RELIABLE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, our warranties are limited to the minimum extent permitted by law.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WITNESSOR, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR REVENUE, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Because the Service is provided free of charge by a nonprofit ministry, these limitations reflect the reasonable allocation of risk between the parties. Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the minimum extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Witnessor and its directors, officers, employees, volunteers, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any action or proceeding arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in Nacogdoches County, Texas, and you consent to personal jurisdiction in those courts, except where mandatory consumer-protection laws of your country of residence provide otherwise.
17. Dispute Resolution
17.1 Informal Resolution
Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute informally within 60 days of receiving your notice.
17.2 Class Action Waiver
To the maximum extent permitted by applicable law, you and Witnessor agree that any dispute will be resolved on an individual basis only and not as a class, collective, or representative action. Where class-action waivers are unenforceable, this section does not apply to that portion of the dispute.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms in the App, update the “Last Updated” date above, and — where required — obtain your renewed acceptance before you can continue using the Service. Your continued use of the Service after the updated Terms take effect constitutes your acceptance.
19. Miscellaneous
- Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Witnessor regarding the Service.
- Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms. Witnessor may assign these Terms without restriction.
- Force Majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
